To prohibit as indecent the broadcasting of any advertisement for a medication for the treatment of erectile dysfunction, and for other purposes.

IN THE HOUSE OF REPRESENTATIVES

April 29, 2009

Mr. MORAN of Virginia (for himself and Mr. BRADY of Pennsylvania) introduced the following bill; which was referred to the Committee on Energy and Commerce

A BILL

To prohibit as indecent the broadcasting of any advertisement for a medication for the treatment of erectile dysfunction, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘Families for ED Advertising Decency Act’.

SEC. 2. DEFINITION OF INDECENCY.

Within 6 months after the date of enactment of this Act, the Federal Communications Commission shall revise the Commission’s interpretations of, and enforcement policies concerning, section 73.3999 of the Commission’s regulations (47 CFR 73.3999), relating to indecent material that no licensee of a radio or television broadcast station shall broadcast on any day between 6 a.m. and 10 p.m., to treat as indecent for such purposes any advertisement for a medication for the treatment of erectile dysfunction or for male enhancement. This section shall not require treating as indecent any product placement or other display or mention merely of the trademarked name or generic name for such a medication.

So it's OK, even if classed as indecent, to broadcast after 10:00pm?

It looks like it's a simple bid to have the ads classified as such to prevent early evening broadcast. But it does bring up the question of what is indecent and what is not.

We get a lot of these ads on Australian TV, normally late at night, although I was surprised earlier this week when one came on just after 9:00pm (which I think is the time before which they can't show them here). But it was shown in bteween a couple of ads for cereal and some other non-descript product. It seemed out of place.

It struck me because here in the US, former Senator Bob Dole, who was the republican majority leader for years, was the first public spokesperson for E.D. His commercials were on all the time pushing Viagra and openly talking about E.D. Now we have the house & senate listing these commercials as "indecent".

And as to showing them only after 10.... well, is that because of the sexual suggestiveness of the commercials or that it's a product for sexual pleasure? What then about the KY jelly commercials were the couple's in bed talking about how they both can get sexual pleasure from using the product? Shouldn't we be moving them, too? And if it's to protect our children from learning about sexuality, how about all the magazines and journals that carry the ads? Seems like the bill's short sighted if that's the reasoning. So I'm really curious here what folks see as the reason for the bill.

My personal opinion... are you ready for this? I think that since it looks like the "fairness doctrine" is not going to pass. I see the Dems cutting the bill up into pieces and get it passed one at a time. It looks less invasive that way. But that is just my opinion, I do admit it is a bit from left field...LOL.
